Reasons Petitioner Should Receive Sole Physical Custody


You will need to explain to the court why petitioner having sole legal and physical custody is in the best interest of your children.

If both petitioner and respondent agree, the reason can be something like: Petitioner and Respondent agree that Petitioner should have sole legal and physical custody.

If petitioner and respondent do not agree, then you should carefully detail why this custody arrangement is in the best interest of the children. The following are some examples:

The children currently live with Petitioner.

Petitioner has been the parent who primarily cared for the children.

The children and Petitioner are the same religion and Petitioner attends all religious services and events with them.

Petitioner is the parent with the better ability to provide for the needs of our children.

Respondent drinks frequently to the point of intoxication in the presence of our children.

Respondent will take our children to Respondent's country and not return them.
